americans killed u.s. ambassador chris stevens, a piedmont native and graduate of the uc hastings school of law. marla has more on what clinton is expected to say. good morning. >> good morning. here is a copy of secretary clinton's testimony. it is embargo'd. i can paraphrase it for you. the work they still have to do in order to protect personality. the united states has 275 posts around the world. she reminds congress since the deadly september 11 attack she has taken responsibility. first up she'll go before the senate foreign relations committee. the questioning will last for 90 minutes. at 11:00 a.m. our time she'll face the house foreign relations committee and answer another 90 minutes of questions. the questions focus on the state department's initial response to

the u.s. consulate bombing in benghazi that left a bay area native and u.s. ambassador chris stef s dead with three other americans. a live look now. she's set to take a seat to begin the hearing. many think the initial response was a cover-up. the white house administration backed off the idea that the attack was. today is her time to face the music. ironically john kerry is expected to be confirmed as the next secretary of state tomorrow. again, the benghazi hearing just getting under way on capitol hill. we are keeping an eye on this to bring you the latest. the next report coming up in 30 minutes. john? >> meantime in the bay area, it took hours of cussing, screaming and debates but this morning oakland finally making a decision on a very controversial

proposal to reduce violent crime. the issue surrounding hiring one of the best known police experts in america. his name -- bill bratton. kristy smith joining us live at oakland city hall. she has more on the nine-hour debate and the ultimate decision made by the counselor. good morning. >> good morning to you. a heated, passionate debate went on for hours. 260 speakers. in the end the council hired bill bratton. he will be a consultant. one of the first things he'll do and the objective is to come up with a policing plan to bring down crime in oakland. it may start with forums like the one we saw overnight. >> seven ayes, one no. >> thank you. >> shame! shame on you! >> reporter: the one no vote, council member brooks. the crowd of protesters shouted things like "shame on you" and

"let the war begin." the $250,000 contract includes hiring former new york and los angeles police chief bill bratton to develop a public safety plan for oakland. one of the state's most violent cities. the speakers included activists, pastors, parents out here. the divide, something you might expect. some worried bratton would bring stop and frisk policies that could lead to racial profiling. others said oakland is desperate for help. >> unfortunate skin color. i hate to say it like that. i have pride in who i am. >> when you can't walk down the street and be safe. you can't go to school. you can't because it's just a war zone that's going on bill bratton is a strategist. >> council approved the hiring of 20 new police techs to help keep regular oakland police officers out on the streets fighting crime.

also allowing the city to pay to bring in ten alimeda sheriff's deputies to patrol for six months in oakland allowing the city to add another police academy some time this year. right now oakland has 615 police officers on force. compare it with five years ago when they had 840. live in oakland, kristy smith, "today in the bay." >> a pair of east bay citys, just say no to medical marijuana. pittsburgh and antioch city councils both voted to ban medical marijuana dispensaries from operating within city limits. pittsburgh will hold the final vote on february 19th. the ban will go into effect 30 days later. antioch's ban stops mobile delivery service. >>s it is back to square one. a proposal to build more than 450 affordable housing units in

#:12. arturo santiago live with new details about the break-in. good morning. >> the only items stolen from the restaurant were bottles of wine. but keep in mind they can range in value from hundreds of dollars up to more than $42,000 for a bottle of cristal. the restaurant is on the 14,500 block of big basin way. these pictureses are from the website. it appear it is burglary took place between midnight sunday and 5:00 a.m. on monday morning. according to the santa clara county sheriff's department the call came in early monday morning. staff were arriving for work and noticed a window was broken. it seemed several bottles of wine valued at several thousand dollars had been taken.

at this point police do not have a description of any suspect. there is no video surveillance to go by. it is called a michelin starred restaurant. the items on the wine list cost anywhere from a $60 sparkling wine to a nearly $43,000 bottle. high end wines with a price list between $100 and $500. we tried getting comments from the restaurant owners but they have declined to make a statement. >> interesting stuff there. >> all right. 6:13 now. here's a check of the top stories. happening now, secretary of state hillary clinton meeting with a congressional panel to open in benghazi. ambassador chris stevens, one of four americans killed in the attack.

ignored stevens concerns about safety at the compound. >> oakland city council will bring in controversial consultant bill bratton in the hopes of decreasing crime in the city. >> trying to figure out what caused a fire in hayes valley. the fire broke out around 2:45 this morning on oak street. both suffered damage on the outside. nobody was injured. >> 6:14. some of san francisco's top tech minds plan to remember that young hacker who took his own life this month. >> we remember that, yes. scott mcgrew said a memorial will attract some of the people who helped create the internet. >> good morning to you. swartz took his life as he faceded prison time for downloading academic papers from

m.i.t. some of the people who helped invent the internet will hold the memorial in san francisco thursday night at the internet archive on funston in the city. i will post more information to the facebook page if you would like to attend. meanwhile the controversial site wikileaks today revealed for the first time that swartz was a financial contributor. may have been one of the reasons the federal government was so eager to prosecute him. >> larry page took part in google's conference call last night. page missed several of these because of issues with his voice and an unspecified illness. here is an executive takeaway. google says it makes less money per ad these days. that's a downward trend that's continuing. it has more users so it balances out. as we watch we note he was there for the second quarter in a row.

apple reports profits. you think the anguish about running out of money maybe? that's not the case. apple still the most valuable company in the united states. it might say growth is slowing. one hint a tea leaf this morning is verizon. the company said it activated 6 million iphones in the past quarter. a good sign that iphones are selling well. but half of those, even less than half were actually iphone 5 as. most were iphone 4s. apple makes more money on the 5. it's interesting to see people start to realize all of the iphones are pretty darn good and they are settling for the four apparently. >> getting a better deal now, too. >> that's why they go for it. thank you very much. >> thank you very much. >> we have a deal for you if you like snow. >> we know you have been known to head up to tahoe. >> i love it. >> put the skis on. >> you will enjoy what's coming up. we're going to get an exclusive report from squaw valley.

as you know it's been a dry january so far. brian hager joins us live. you say the skiing and snow boarding is rather epic out there. it's been dry. >> yes, good morning. skiing and snowboarding is great. the cold weather over the past couple of days has been keeping it hard and fresh. we hope for something out of the storm passing through. >> tonight into tomorrow hopefully we'll pick up more powder. what do people like to do in tahoe? do they hit the bunny slopes? are they skiing in the parks? what are they up there for this time of year? >> we have a mix. a lot of families, the kids take lessons. the older kids hit the train parks. parents want to go off and do their own thing, explore the mountain. it's a mix of everything together. >> a winter wonderland. thank you, brian. excellent news. let's look at the conditions we are expecting in squaw

throughout the day. more snowfall coming down. 38 degrees makes for good skiing conditions on thursday. over six feet of powder. alpine meadows looking good. 69 inches at the bay. really, really great skiing conditions. it's been a dry month so far. closer to the weekend you're probably thinking about tahoe. another report coming in tomorrow morning. 44 degrees in liverer many. a nice mild start to the day. 48 degrees in sunny vail. area of low pressure. this is the weathermaker. it will fall apart over the bay area. mostly bringing heavy shower activity to the pacific northwest. we need the rain. it's been dry so far. any drop in the bucket will help, especially when it comes to air quality. i will point out the spare the air day right off the bat. you can expect showers outside your doorstep. mostly dry so you can commute safely to work without having to drive on the slick row.

good morning, everybody. i'm john kelly. >> i'm laura garcia-cannon. apple could report its first profit drop despite the fact they are expected to have record revenue from iphone sales. scott mcgrew joins us from the newsroom now. apple set the pace in the tech industry for so long. is the drop in profit the real concern here or is it that other tech companies are starting to catch up to apple and could soon outrun it? >> one cause it is other. there is genuine concern apple is falling behind other companies. particularly samsung in attracting new young customers. for all the anguish we are talking about with apple it will still be the world's most important company no matter what it's going to report it made an incredible amount of makeup. we're sure of that. the fear is the rocket-like growth is slowing or reducing

itself. blumberg speculated apple may make more profit this quarter than last. wall street doesn't like down arrows. we have anecdotal evidence about trouble at apple including last week sharp said it would make fewer screens for the big apple ipad. the concerns may not show up today. you slow down if future sales will slow. >> very interesting there. what does it mean for tim cook? is she still the right man for the job? >> absolutely. he's had challenges. apple maps is a good example. the stock is down 20% from highs. nobody on planet earth knows how to run apple better than tim cook. he's steve's hand-picked successor before becoming ceo he ran the factory system.

sandy hook elementary is prompting two local school districts to make a big change. the lafayette school trick-or-treat plans to replace classroom door locks with ones that can be locked from the inside. the upgrade will cost less than $60,000. by mid march all classrooms and room doors will also be able to be locked from the inside. just last night the school board approved spending up to $100,000 to buy and install the new hardware. >> the tragedy at sandy hook prompting a national debate about gun control. now the nation's most powerful gun lobby striking back at the president's plan to curb gun violence. during monday's inaugural address president obama addressed gun violence saying americans shouldn't, quote, mistake absolutism for principle or substitute spectacle for politics or treat name calling as reasoned debate. in reno last night nra's

welcome back, everybody. u.s. and canadian cargo planes assisting the french military mission in mali. the french spent weeks battling what they call islamic rebels in the country. until now the u.s. and canada

officials were limited to logistics support of the french mission. the u.s. has not given exact details on how many of the planes are involved. >> one person is clinging to life. two are injured after a fight ended in gun it is fire at a community college in houston, texas. a maintenance worker was among the injured after being caught in the cross fire. a 22-year-old man was charged with aggravated assault in that shooting. so far investigators haven't released other details about what led up to the fight. >> an actor best known as the voice of charlie brown now under arrest on several charges including stalking. 56-year-old peter robins was the voice of charlie brown for several tv specials including "a charlie brown christmas." u.s. customs and border protection says robins was arrested on sunday at the san ysidro port of entry. the sheriff's department has not released other specifics on the case. robins is scheduled to be

stevens. a piedmont native and the uc hastings school of law. marla joins frus the newsroom. at issue is whether the state department ignored the concerns about the safety at the compound. >> i have a copy of secretary clinton's opening remarks to oh the senate foreign relations committee. nowhere in it does she mention ambassador stevens's request for more security. she began with listing almost 20 other attacks that happened at other u.s. consulates worldwide since 1988. in regard to the bombing that took the life of four americans she says since september 11 as i have said many times i take responsibility. when talking about the state department's response to the attack which many republicans believe was a cover-up which is what she had to say. quote, the very next morning i told the american people that heavily armed militants

assaulted our compound and vowed to bring them to justice. i said with president obama as he spoke of an act of terror. clinton says the state department has focused on al qaeda, putting pressure on the terror group. at one point when talking about the loss of stevens who she knew well and trying to console the family she actually got choked up. the hearing are expected to last until 1:00 our time this afternoon. she has quite a day ahead. this is likely the last time she'll be in the hot seat as her career as secretary of state is coming to an end. in fact, john kerry is expected to be confirmed by congress for the post tomorrow. >> marla, thank you very much. also happening now on capitol hill, lawmakers there preparing to vote on a proposal also a

measure to withhold pay for either house or senate members if they fail to pass the budget plan. the senate hasn't passed the budget since 2008. the proposal is meant to pressure the senate and only delay a potential debt disaster. >> let's check the forecast now with christina loren. rain in the works. >> it's not that cold out there finally. getting a little bit of a break in the temperature department that, like laura pointed out we have showers on the way. the disturbance moving into the north bay. mostly cloudy, drizzly with thick low cloud cover. haven't had reports yet. it's possible. this is a live look at san jose. same overcast sky overhead. dry highways for now. you should stay dry throughout the morning drive unless you are waking up in the north bay.

this is what we are tracking. slick conditions from santa rosa to petaluma. light showers pass through there. mostly dry bay area. just want to point out where we are temperature wise. 48 degrees in san jose. 20 degrees warmer this morning than 24 hours ago. napa at 52 degrees. the clouds issued in by the cold front won't bring about cold air. highs in the upper 50s today. cold air behind it moves in tomorrow. you can count on for today mainly 50s at the coast. inland 50s and 60s and showers work like this. staying mostly cloudy, mothsly dry for the morning drive which is good. you will have a rough evening commute with showers coming in between 12:00 and 5:00. that means travel cautiously. it's been dry so we have a rot of oil on the roadways. needs to be washed off by the upcoming showers. we'll talk to mike in a moment about the drive. notice on the traffic cams

slowing out there. 10:00 p.m. wednesday, showers deteriorate a little bit. we'll have resill sij wall activity. temps in the upper 50s. places like oakland. thursday into friday. a little bit of a dry break. i call the showers pesky. they are just annoying. not anything heavy but enough moisture so you want the umbrella handy. would you call this a trip call drive on a wednesday, mike? >> overall the volume pretty typical for a friday. we'll show you an unusual pattern as far as the backups go. normal overall. south bay. north 85 with heavier traffic than we typically see because of the crash that happened at the saratoga crossing involves cars. sounds like everything is in the center divide but the distraction causing slowing as the volume building up on a wednesday wednesday. we are seeing a heavier flow for

highway 87. there may be a shift going on. we see the northbound routes slowing for the south bay. we'll look at the peninsula and get more cars for palo alto north past university toward willow up into san mateo and the city. no delays. speeds at the limit for 101 and 280. both directions for the area. the southbound side building. we'll see as the sun comes up the southbound side slows here and 280. coming across the bay the san mateo bridge shows a good volume. this is the camera on the peninsula with a smooth flow. eastbound with the tail lights, easy flow to the hayward side. a look at the maps as well. we do have slowing heading south on 880 coming off the caster valley for north 238. here a concern coming into we recollectly west 80 at university avenue. the earlier crash reportedly blocking one lane causing more slowing off the merge with folks

back at san pablo. we have a live shot of the fast track lanes slowing like the cash lanes are. back to you. >> thank you, mike. now a follow up to a story we have been covering since monday. an under cover detective recovering after bheing shot in the arm in oakland which touched off a man hunt that lasted nearly 24 hours. the oakland s.w.a.t. team arrested five alleged gang members in connection with the attack. two suspects were arrested on parole violations. >> the shooting just one example of oakland's surge in violent crime. the controversy surrounds a proposal to spend a quarter of a million dollars to hire bill bratton. kristy smith joins us live from

very expensive break-in. good morning. >> good morning, john. it's called a michelin starred restaurant on the high end of the scale. a lot of wines and sparkling wines they offer could have a price tag of hundreds or thousands of dollars. these are pictures from the restaurant's website. items from a $60 bottle of sparkling wine to a $43,000 bottle of cristal millennium. the price ranges between $100 and $500. the burglary took place between midnight sunday and 5:00 a.m. monday morning. the call came in early on monday morning from staff who were arriving for work. when they checked to see if anything was missing several bottles of wine valued at several thousand dollars had been taken.
